1. Product and Service

AnyTale is a digital platform enabling users to create personalized children's books using AI-assisted tools. Features include writing/editing with AI assistance, customizing illustrations and characters, exporting books, and optionally publishing to the affiliated AnyTale reading app.

The company reserves the right to modify, enhance, suspend, or terminate services at its discretion. If such changes materially affect your rights or obligations, we will provide timely notice through in-platform notifications, email, or website announcements.

The platform makes no guarantee of availability in all jurisdictions or that the output will meet your expectations or align perfectly with the input provided. AI-generated content may not be unique and may incorporate publicly available sources.

2. Account

2.1 Eligibility

Services are primarily for adults. Users under 18 must read terms with a legal guardian and use services with explicit consent and supervision.

2.2 Registration

Users must provide accurate information via email or third-party login (Google, Meta, etc.). False or misleading information may result in feature denial, account suspension, or permanent restriction.

2.3 User Responsibilities

Users must keep login credentials confidential, not register multiple accounts for malicious purposes, and not transfer accounts to others.

2.4 Account Security

Users are responsible for safeguarding passwords and verification codes. You are solely responsible for any losses resulting from unauthorized access due to your negligence, except in cases where the loss results from AnyTale's intentional or grossly negligent conduct.

2.5 Account Deletion

Users may delete accounts anytime. The company may retain data as required by law and reserves enforcement rights for prior violations.

2.6 Access Credentials

Users must safeguard API keys and credentials. You are solely liable for any usage fees or damages incurred because of unauthorized access caused by the sharing or leaking of your access data.

3. Requirements and Restrictions

3.1 License and Use

AnyTale grants a limited, revocable, non-exclusive, and non-transferable license to access and use the Platform and its services solely for lawful and permitted purposes.

Users publishing content must verify authenticity and legality, disclose AI generation, and comply with content restrictions.

3.2 User Conduct

Users must comply with terms, applicable laws, and principles of fairness and good faith.

3.3 Monitoring

AnyTale reserves the right to monitor inputs and outputs, apply risk-detection filters, and maintain prohibited content databases.

3.4 Prohibited Content

Users cannot generate content that is:

Hateful, defamatory, abusive, offensive, or vulgar Intentionally provocative, antagonizing, bullying, or harassing Threatening, intimidating, or causing distress Discriminatory based on protected characteristics Pornographic, obscene, or sexually explicit Promoting violence, terrorism, or extremism Exploiting or harming minors Targeting children inappropriately Encouraging criminal behavior Impersonating real persons without disclosure Containing political propaganda or campaigning

3.5 Security Violations

Prohibited actions include unauthorized access attempts, malware distribution, reverse engineering, automated scraping, and threats to platform integrity.

3.6 Unlawful Uses

Services cannot be used for illegal purposes, causing harm, infringing IP rights, or replicating/sublicensing services.

4. Inputs and Outputs

4.1 User Responsibility

You are solely responsible for all Inputs you provide to the Platform, including text, prompts, uploaded media, and other user-submitted content. Users represent they have necessary rights and that inputs/outputs don't violate terms or laws.

4.2 Ownership

Users retain rights in their inputs. AnyTale assigns to you any rights it may have in the Outputs generated through your lawful use of the Services. Outputs may be used for personal and commercial purposes if compliant with terms and laws.

4.3 AI Improvement

AnyTale may use anonymized inputs and outputs for service improvement under strict conditions with secure encryption and de-identification measures.

4.4 AI Output Nature

All outputs are AI-generated and may contain inaccuracies, inconsistencies, or unintended results. The platform is intended primarily for entertainment and creative storytelling, not medical, legal, or factual reporting.

4.5 AI Disclosure

AnyTale provides visible disclaimers indicating AI creation. You agree not to remove, hide, or misrepresent these notices when publishing, distributing, or presenting generated content.

4.6 Output Quality

Quality varies based on input clarity. Users acknowledge AnyTale may occasionally generate incomplete, inaccurate, or inappropriate Outputs.

5. Intellectual Property

5.1 Platform Ownership

AnyTale holds all IP rights to the platform, including software, algorithms, AI models, designs, logos, trademarks, and content, except where expressly stated otherwise.

5.2 Brand Restrictions

Without written permission, users cannot use "AnyTale" or associated trademarks, domain names, or visual branding. Users cannot register related domain names, use marks in advertising, or suggest sponsorship/endorsement.

6. Commercial Use

6.1 Rights

Users may use generated content for personal or commercial purposes (publishing, selling via third-party platforms) if inputs were lawful, outputs don't infringe third-party rights, and use complies with content restrictions.

6.2 No Guarantee

AnyTale does not guarantee any financial return, visibility, platform promotion, or commercial success resulting from your use of generated content.

6.3 Attribution

Users distributing AI-generated content must clearly indicate that the content was generated using AI unless substantially modified. Attribution disclaimers may be required for scaled distribution.

6.4 AnyTale Publication

Content submitted to AnyTale must pass manual moderation. Approval is not guaranteed, and AnyTale reserves the right to request revisions, reject content, or delay publishing.

6.5 License Back

By generating content, users grant AnyTale a non-exclusive, royalty-free, worldwide license to use selected books, characters, or elements as templates or references for future AI training, platform examples, or content continuation features. This is internal use only and doesn't affect user ownership unless otherwise stated.

7. Paid Subscriptions

Fees are disclosed before purchase and subject to applicable taxes.

7.1 Fees

Subscription fees automatically renew until cancellation. If payment fails, accounts may be suspended or downgraded.

7.2 Service Credits

Credits are non-transferable, non-refundable (except by law), and must be used within validity periods.

7.3 Cooling-Off Period

Consumers in jurisdictions granting statutory cooling-off periods (e.g., EU) may cancel within 14 days for pro-rata refunds.

7.4 Cancellation

After cooling-off periods, users may cancel anytime via account settings. Benefits continue through the paid period with no refund for unused days.

7.5 Price Changes

AnyTale may change prices with 30 days' notice. Price changes apply at next renewal. Users may cancel before changes take effect.

8. Complaints and Feedback

Users may report IP violations, legal violations, or inappropriate content via the "Contact Us" interface or email (anytale.post@gmail.com). We take all reports and feedback seriously. Where appropriate, we will investigate, take corrective measures, and pursue legal action if necessary.

9. Disclaimer of Warranties, Limitation of Liability, and Indemnity

9.1 Statutory Rights

Nothing in these Terms affects your non-waivable statutory rights as a consumer under applicable law.

9.2 Enforcement

Violations may result in warnings, feature restrictions, account suspension, or permanent closure. Suspected illegal actions may be reported to law enforcement. Users must compensate AnyTale for reasonable losses incurred as a result, including but not limited to legal fees, attorney fees, investigation costs, and administrative penalties.

9.3 No Warranties

The Services are provided on an "as is" and "as available" basis. No warranties cover quality, fitness, uninterrupted service, security, accuracy of outputs, defect correction, or third-party service reliability.

9.4 Limitation of Liability

Parties are not liable for incidental, consequential, punitive, special, or indirect damages including loss of profits, business interruption, loss of data or goodwill, except for intentional misconduct or gross negligence.

9.5 Indemnity

Users must indemnify, defend, and hold harmless AnyTale, its affiliates, and licensors from and against any third-party claims, losses, liabilities, damages, costs, or expenses arising from your violation of these Terms, your use of the Services in violation of laws or third-party rights, your fraud or misconduct, or any content you upload or publish that causes legal harm.

10. Export Control and Sanctions Compliance

Users represent they are not located in sanctioned countries (Cuba, Iran, North Korea, Syria, Crimea, etc.), not on restricted party lists, and will not use services for prohibited end uses. You are solely responsible for compliance with all applicable Export Control Laws.

11. Governing Law and Jurisdiction

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Latvia, without regard to its conflict of law provisions.

11.2 Dispute Resolution

Parties must first attempt amicable resolution through negotiation. Unresolved disputes may be submitted to competent courts in Latvia's jurisdiction.

12. Miscellaneous

12.1 Updates

AnyTale may revise terms to improve services, reflect legal changes, or address technology updates. Revised terms become effective upon posting. Continued use constitutes acceptance.
